Sri Somveer learned counsel for the petitioner submits that the petitioner is the election petitioner in Election Petition No 03 of 2017 which is pending before the Addl District Judge (FTC) Court no 02 Hathras.
The learned counsel submits that the respondent no 4 was declared elected as Member of Gram Panchayat on 1.12.2017 and the election petition was filed on 22.2.2017. However, till date, the election petition is still lingering and has not been decided as yet.
Considered the submissions made across the bar and perused the record.
In the light of the judgment of Supreme Court in M/S Shiv Cotex Vs Tirgun Auto Plast P. Ltd and others 2011 (89) ALR 232, the learned trial court is directed that the election petition mentioned above be decided expeditiously. The court below shall ensure that no unnecessary adjournments are granted and the case should proceed from date to date till its disposal.
The petition is disposed of finally in terms of the above directions.
