Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
By means of the present writ petition, the petitioner herein seeks for quashing of the impugned First Information Report dated 23.6.2021 registered as Case Crime No. 201 of 2021, under Sections 376, 354-Ka, 506 and 420 I.P.C. police station Nawabad, District Jhansi.
From a careful reading of the first information report, it appears that the respondent no. 4 could not get internal promotion in the institute known as Maharani Laxmi Bai Medical College, Nawabad, Jhansi. The complainant / respondent no. 4 was working as a staff nurse and the petitioner herein, as Junior Resident-III (internal medicine), therein.
Let a notice be issued to respondent no. 4 indicating the date in 4th week of September, 2021.
Let this matter be posted in the additional cause list on the date fixed in the notice.
Till the next date of listing, the petitioner shall not be arrested pursuant to the aforesaid first information report provided he cooperates in the investigation. He shall not make endeavour to influence any witness or tamper in evidence and would not cast any pressure upon the complainant/ the respondent no.4.
In the meantime, learned counsel for the respondents may file their reply.
