THIS PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent- State.
The petitioner/accused No.2 along with six others is charge sheeted by the respondent-Police in their Crime No.103/2014 in respect of offences punishable under Sections 120(B), 396, 397, 302 and 201 of IPC, on the allegation of committing decoity and murder etc., 2. This is his fourth unsuccessful petition before this Court.
3. Sri Dinesh Kumar K., learned counsel for the petitioner submits that his father is a chronic heart patient and bed ridden. He needs immediate medical assistance. His mother is also diagnosed for heart ailment. They have no help to avail medical assistance. In the circumstances, he may be granted bail for a period of three months, so that he can attend the medical needs of his parents. He is ready to abide any condition that may be imposed on him.
4. Learned HCGP opposes the petition. However, by appreciating the medical records annexed to the petition, it is felt that there is no impediment to grant bail for a limited period of three weeks.
Accordingly, petition is partly allowed. Petitioner is enlarged on bail in Crime No.103/2014 registered by the respondent-Police, for a limited period of three weeks from the date of his release from the judicial custody on executing a self bond for a sum of Rs.1,00,000/- with one surety for the likesum.
During such period, he shall not leave the vicinity of Bangalore and shall not make any effort to tamper or manipulate the prosecution witnesses.
He shall surrender before the concerned Court on 22nd day of his release at 11.00 a.m., In view of disposal of the petition, I.A.No.1/2017 for interim bail does not survive for consideration and it is accordingly disposed of.
