Court No. - 37
Case :- WRIT - A No. - 6393 of 2018 Petitioner :- Madhu Kashyap And 8 Others Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Vivek Mishra Counsel for Respondent :- C.S.C.
Hon'ble Suneet Kumar,J.
Heard learned counsel for the parties.
Petitioners are constables working with the civil police. Record would reflect that petitioners were transferred sometime between 2011 to 2016, however, they have continued to retain their official accommodations, consequently, the impugned notices have been issued to vacate the premises.
Learned counsel for the petitioner submits that children of the petitioners are students and are appearing for the board examinations, in the circumstances, it is urged that they may be permitted to continue with the official accommodation till the end of April 2018.
Having due regard to the facts and circumstances of the case, I am not inclined to interfere with the impugned notices. The petition being devoid of merit is, accordingly, dismissed.
However, dismissal of the petition shall not preclude the petitioner from arising their grievance with the competent authority, if they so desire and are advised. It is made clear that the Court has not considered the case of the petitioners on merit.
