Heard Shri M.P. Singh Yadav, learned counsel for the petitioner and Shri Jai Narain, learned AGA for the State and perused the material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 09.06.2019 registered as case crime no. 0074 of 2019 under sections 363, 366, 504, 506 I.P.C. and section 3(1)(i) of SC/ST Act, Police Station- Moosanagar, District- Ram Bai Nagar (Kanpur Dehat).
Learned counsel for the petitioner submits that as per FIR victim is stated to be minor and he further stated that as per voter list petitioner no.1 (victim) is major.
Learned AGA opposed the prayer for quashing of the FIR and submitted that the victim is minor.
After having examined the submissions advanced by learned counsel for the parties and perused the impugned FIR, we are of the opinion that the impugned FIR discloses cognizable offence against the petitioner, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR or for grant of any interim relief to the petitioner.
The petition lacks merit and is, accordingly, dismissed.
