Sri S.K. Lal, learned counsel for the petitioner and learned Standing counsel for the State-respondent.
This writ petition has been listed under the heading of group of cases likely to be infructuous (without objection).
Learned counsel for the petitioner states that the matter is still surviving and the he argued the matter.
This writ petition has been filed in the year 2002 challenging the order dated 18th July, 2002, whereby the petitioner along with other collection amins and peons were directed to complete the recovery target in future. The recovery made by the petitioner is only 66% of the target fixed, hence by the order impugned while withholding salary of the petitioner along with other collection amins/ peons for the month of June, 2002, charge sheet was also directed to be issued to him.
No counter affidavit has been filed till date, in spite of the fact that time was granted to learned Standing counsel on 4.2.2003. Thereafter, no order has been passed by the Court. The petitioner also has failed to bring on record the subsequent development on the point whether any charge-sheet has been issued to him or not pursuant to the order impugned.
In these circumstances, this Court is of the opinion, that the order impugned cannot be quashed. The writ petition lacks merit and is accordingly dismissed.
