1. This petition has been filed for a direction to be issued to the learned trial court to decide Original Suit No.165 of 2010 (Shiv Singh vs. Suresh and another) at the earliest. It has been submitted by the learned counsel for the petitioners that issues have been framed in the said suit on 09.07.2012 and it has been pending since then. During the pendency of the Suit, the plaintiff Shiv Singh died and his sons already being on record, only an amendment application was filed which has also been allowed on 02.08.2019.
2. Learned counsel for the petitioner says that the copy of the entire order-sheet of the case has been filed as annexure-2 to this petition. It shows that repeatedly the matter is being adjourned and no effective hearing is taking place.
3. This petition is disposed of with a direction to the learned trial court to keep in mind the instructions issued on the administrative side by the High Court for the sub-ordinate judiciary to hear and decide the case pending for years or more on a priority basis.
