Having heard learned APP and perusing the petition filed through jail and considering the facts and circumstances of the case, I am inclined to give benefit of the decision of the Full Bench of this Court dated 30.9.2008 in the case of Suo-motu vs. State of Gujarat in Criminal Reference No.2 of 2008 and the decision of the learned Single Judge of this Court in the case of Zahida Razakbhai Makrani vs. State of Gujarat, reported in 2011(0) GLHEL-HC 225804, dated September 2, 2011. Consequently, the petitioner is set at liberty forthwith on furnishing a personal bond to the satisfaction of the jail authority, if the petitioner is not required in any other offence.
Issue rule returnable on 4th May, 2012.
Registry is directed to send copy of the order to the Jail Authority and shall serve notice of rule to Nathiben Madhabhai Sadia, residing at Aarambhada, Jamkhambhalia, District Jamnagar.
