Order:
This Writ Petition is filed for a Mandamus to direct respondent No.4 to appoint the petitioner as the fair price shop dealer under the scheme of compassionate appointment as per G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014.
The petitioner pleaded that, while working as permanent dealer of fair price shop No.33 of Vegiwada Village, Pedavegi Mandal, West Godavari District, her husband had died on 29.11.2012; that as she is entitled to be appointed in the said vacancy as per the above-mentioned GO, she made a representation on 12-07-2014 followed by another representation on 13-10-2014, requesting respondent No.4 to appoint her as such in the place of her deceased husband. The grievance of the petitioner is that respondent No.4 has not passed any order on her representations so far.
The learned Assistant Government Pleader for Civil Supplies (AP), representing the respondents, submitted that till recently, there was a ban on compassionate appointments and that, if respondent No.4 has received the petitioner’s representations, he will consider the same, take a decision thereon and communicate the same to the petitioner.
In the light of the above facts and circumstances and also the submissions of the learned Assistant Government Pleader for Civil Supplies, respondent No.4 is directed to consider the petitioner’s representations for appointment as fair price shop dealer in the vacancy arising out of the death of her husband, as per G.O.Ms.No.4, dated 28-02-2014, and communicate his decision to the petitioner within one month from the date of receipt of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.47887 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
