The petitioners claim themselves to be landless labourers and their hutment has been constructed over the Abadi land which according to the petitioners, respondents No.5 and 6 are threatening to demolish. In case, the petitioners are landless labourers, they can pray for grant of lease before the Gaon Sabha or if they have their right over the land in question and any private individual is threatening, the petitioners have a remedy of filing a suit . In writ proceedings, such a direction as prayed for cannot be issued.
The writ petition is misconceived and is dismissed.
