Petitioner claims to be a retired employee of respondent U.P. Jal Nigam. His grievance is that though substantial period has expired since his retirement on 31.1.2020 but entire retiral dues have not been paid to petitioner till date.
Learned counsel for the respondents states that an appropriate decision would be taken by the authority competent, in accordance with law.
Law is settled that payment of retiral dues is entitlement of employee concerned and such amount cannot be withheld except for valid reasons. Claim of petitioner for release of retiral benefits, therefore, needs to be examined, forthwith, by the first respondent.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent no.1 to accord consideration to petitioner's claim for release of retiral benefits and to ensure that the balance retiral dues found and due to petitioner is released, within a period of four months from the date of presentation of a copy of this order.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
