JUDGMENT S.P. Srivastava, A.C.J.
1. Heard the learned Counsel for the appellant.
2. The appellant, who is the owner of the offending motor vehicle, a truck, feels aggrieved by the award of the Motor Vehicles Accident Claims Tribunal, Chitrakoot, dated 12.11.2002, in M.A.C. No. 118/70-1997, determining an amount of Rs. 1,75,000/- (Rs. one lakh and seventy-five thousand) to be the just compensation to which the dependent of the deceased, the claimant, was found entitled to on account of the death of the sole bread-winner in an accident involving the offending motor vehicle.
2. Learned Counsel for the appellant has tried to assail the findings returned by the Tribunal against the appellant. The Tribunal, after a careful consideration of the evidence as brought on record, had come to the conclusion that the offending motor vehicle - the truck - owned by the present appellant, was involved in the accident and the claim of the appellant to the contrary was false. It has also been found that the deceased was travelling in the aforesaid truck and had met his untimely death on account of the accident.
3. Along with the appeal, copies of the statements of the witnesses examined before the Tribunal have also been annexed. We have perused the oral evidence and the other materials brought on the record. The findings returned against the appellant could not be demonstrated to be suffering from any such legal infirmity which may justify an interference therein. The findings returned by the Tribunal are amply supported by the evidence and materials brought on record.
4. No justifiable ground has been made out requiring any interference in the evaluation of the evidence done by the Tribunal.
Taking into consideration the totality of the circumstances, this appeal is clearly devoid of merit and is hereby dismissed in limine.
