Learned counsel for the applicant has filed supplementary affidavit, the same is taken on record.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record of the application.
The core submission of learned counsel for the applicant is that he wants to withdraw this bail application but he may be granted one last opportunity of hearing before the lower court, as trial court without hearing the applicant, straightway cancelled the bail of the applicant.
Learned A.G.A. has submitted that if applicant cooperates with the trial and remains present before the court concerned, then he may be given some reasonable time for raising his plea by way of objection before the trial court.
I have considered the rival submissions.
Under the facts and circumstances of the case, it appears that the grievance of the applicant shall be redressed, when he moves his objection to the bail cancellation application within a period of 15 days from today before the trial court concerned and, in case, any such objection is so moved, then the prosecution or the informant of the case, as the case may be, shall be accorded opportunity to rebut the same and the trial court shall pass the order on the application dated 17.5.2019 moved by one- Suman Rani, certified copy whereof has placed on record vide Annexure No.6.
In view of above, this bail application is dismissed as not pressed.
