This Transfer Criminal Petition is filed under section 407 Cr.P.C. to transfer CC.No. 645 of 2011 on the file of II-Additional Judicial Magistrate of First Class, Tanuku, West Godavari district to III- Metropolitan Magistrate, Visakhapatnam to be tried along with CC.No.87 of 2012 and to pass such other suitable orders as this court may deem fit and proper in the circumstances of the case.
2. When the matter is listed on 24/04/2014 proof of service is not filed and none appeared for petitioner and the matter is directed to be listed on 25/04/2014 “for dismissal”. Today, when the matter is posted under the caption of dismissal, Advocate for petitioner sought permission of this Court to withdraw this Transfer Criminal Petition.
