Heard Sri Ashwani Kumar Sachan, learned counsel for the applicant and Sri I.P. Srivastava learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the deceased was having some illicit relationship with the wife of the applicant and hence the present FIR. It has been further submitted that the case is of single provocation. The applicant is in jail since 3.12.2014.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that the deceased was done to death by Farsa and has received as many as five injuries on his person out of which four are incised wounds and a recovery of Farsa has been made from the possession of the appellant to which learned counsel for the applicant contented to be a false one.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Maan Singh involved in Sessions Trial No. 90 of 2015 (State vs. Maan Singh and others) in Case Crime No. 260 of 2014 under Section 302 I.P.C., police station Bhuta, District Bareilly.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
