Heard learned counsel for the applicant and learned AGA. It is contended by the learned counsel for the applicant that the complaint of the present case is a counter blast of the F.I.R. of case crime no. 43 of 2008 under section 392 IPC lodged by Maan Singh Soni against unknown person, in which the opposite party no. 2 was sent to jail. Thereafter in respect of the incident dated 29.2.08, the complaint of this case has been lodged which is based on false and frivolous allegations.
Issue notice to opposite party no.2 returnable within four weeks, Considering the submissions made by learned counsel for the applicant, the further proceedings of criminal case no. 294 (IX)/ 2009 under section 420, 406, 504, 506 IPC pending in the court of Judicial Magistrate Vth, Mathura shall remain stayed till the next date of listing.
List after four weeks for orders.
