The petitioners are an inter college located at Azamgarh. It appears that during the Academic Session 2020-21, process of allotment of centre for holding examinations was initiated. The petitioners completed all formalities and submitted their application on 12.02.2020, requesting that the examination centre for high school and intermediate examinations be alloted to them. A list of proposed centres was published by the District Inspector of Schools, Azamgarh (for short "DIOS"), wherein the petitioner-college's name did not find place. The petitioners have filed a representation in the matter on 27.01.2021.
Grievance of the petitioners is that no decision on their representation dated 27.01.2021 has been taken. It has been averred that there is not a single complaint against the petitioner as an institution, so as to exclude them from consideration for allotment of the examination centre. It is also submitted that the petitioners are eligible and excluding them from the list of proposed schools, where examination centres during the Academic Session 2020-21 would be there, is manifestly illegal.
After hearing learned Counsel for the petitioner and the learned Standing Counsel, this Court is of opinion that the DIOS ought to take a decision on the petitioners' pending representation dated 27.01.2021 within a week of receipt of a copy of this order and decide the same by a reasoned and speaking order.
The decision taken by the DIOS ought to be communicated to the petitioner within a week thereafter.
Accordingly, it is ordered that the DIOS shall decide the petitioners' representation dated 27.01.2021 within a week of receipt of a copy of this order by a reasoned and speaking and in accordance with law. The decision taken shall be communicated to the petitioner within a week of the decision being recorded by the DIOS to the petitioner.
This writ petition is disposed of in terms of the orders aforesaid.
Let this order be communicated to the DIOS, Azamgarh by the Joint Registrar (Compliance), within next 24 hours.
