Learned Chief Standing Counsel has accepted notice on behalf of opposite party No.1. Mr. Shishir Jain appears for the opposite parties 2 and 3.
It is submitted by the parties' counsel that the controversy is covered by earlier judgment and order dated 21.9.2010, passed by this Court in writ petition No.9417(M/B) of 2010. Accordingly, with their consent , we proceed to decide the present writ petition finally at admission stage.
In pursuance of the order dated 13.2.2009 passed in Writ Petition No. 1592 (MB) of 2009, in re: Committee of Management, Maa Gayatri Arya Kanya Mahavidyalaya vs. State of U.P. and others, and other connected writ petitions, the students of the petitioner-institution have been allowed to appear in the examination of B.Ed. Class for the academic session 2007-08, but their results are not being declared on the pretext that the order passed aforesaid only directs for allowing the students to appear in the examination and there is no direction for declaration of result. The examinations were conducted by the University between 24.2.2010 to 26.2.2010.
Looking to the controversy raised, we are constrained to observe that when in the aforesaid writ petition, a detailed order was passed, directing the students to appear in the examination, there would have been little justification for the University for not declaring the results.
However, in view of the prayer made, we direct that in pursuance of the order passed in the aforesaid writ petition, the results of the students of the petitioner-institution be declared and the mark-sheet be also issued to them forthwith.
The writ petition is disposed of accordingly. No order as to costs.
