COMMON ORDER:
These Writ Petitions have been filed questioning the stereotyped orders passed by the same officer i.e., the Revenue Divisional Officer, Gurazala-respondent No.2, suspending the fair price shop authorisations of the petitioners.
Having regard to the flimsy nature of the allegations on which proceedings have been initiated and authorisations of the petitioners have been suspended, this Court has summoned respondent No.2 to the Court.
Formal counter-affidavits have also been filed.
At the hearing, Sri A.V. Sivaiah, learned Government Pleader for Civil Supplies, in all fairness, submitted that the orders passed by respondent No.2 are not sustainable in law or on facts and that therefore the impugned orders may be set-aside. He has further submitted that further proceedings in connection with the report of the Tahsildar, Durgi based on which the impugned proceedings have been initiated will not be continued and further action will be closed.
In the light of the above submissions, without delving into the conduct of respondent No.2 in passing the impugned orders, the Writ Petitions are allowed and the impugned orders are quashed with the direction to respondent No.2 to close all further action against the petitioners.
As a sequel to the disposal of the Writ Petitions, WPMP No.39011 of 2014 in W.P.No.31211 of 2014 and WPMP No.39029 of 2014 in W.P.No.31227 of 2014 are disposed of as infructuous.
