Learned advocate for the petitioner submits that learned 6th Additional Sessions Judge, Rajkot erred in exercising revisional powers under Section 397 of the Code of Criminal Procedure, 1973 at a belated stage when earlier the parties had given a consent to close the evidence and the learned Magistrate had rejected the application for deposing the complainant for re-examination from the accused side.
