On previous occasion it is noticed that the written statement / reply filed by the defendant is not available on record and is missing from the record / file of the suit. Mr.Dakshesh Mehta, learned advocate for the defendant had asserted that the written statement has been filed. His assertion prima facie appear to be justified because the plaintiff has filed rejoinder as well, and the rejoinder is available on record. The office was, therefore, directed to file the report. Today also the reply / written statement of the defendant has not been placed on record and office has tendered a vague report. Thus, so as to obtain appropriate report from the Registry for the present proceedings, the matter is adjourned to 22nd November 2011.
