(By Sri.B.Balakrishna, AGA) …Respondents This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct respondent Nos.2 and 3 to handover the further investigation in Crime No.96/2016 of respondent No.4 police station to the respondent No.5 CCB Police to conduct effecting investigation as per law by considering the representation dated 09.02.2018 at Annexure-D and E.
This Writ Petition coming on for Preliminary Hearing, this day, the Court made the following:-
ORDER Sri.Ranjan Kumar.K, learned counsel for the petitioner.
Sri.B.Balakrishna, learned Additional Government Advocate for the respondents.
2. In this petition, the petitioner inter alia has prayed for the following relief:
“i. Issue a writ in the nature of mandamus directing the respondent No.2 and 3 to handover the further investigation in Crime No.96/2016 of respondent No.4 police station to the respondent No.5 CCB Police to conduct effecting investigation as per law by considering the representation dated 09.02.2018 at Annexure-D and E.”
3. When the matter was taken up today, learned Additional Government Advocate submitted that after investigation ‘C’ Report has been filed on 20.11.2017 and a copy of the same has been supplied to learned counsel for the petitioner.
4. In view of the aforesaid, learned counsel for the petitioner seeks leave of this Court to withdraw of the writ petition with liberty to the petitioner to take recourse to such remedy as may be available to him under the law.
Accordingly, the writ petition is disposed of with liberty as aforesaid.
