By the impugned order dated 26.08.2016 in Crl.M.P.No.1859 of 2016 in Crime No.605 of 2016, the learned V Metropolitan Magistrate, Egmore, Chennai, handed over the interim custody of the auto- rickshaw bearing Registration No.TN-04-R-4219 on certain conditions, to the petitioner, which was originally seized from the petitioner. The first condition imposed is that the petitioner has to execute a bond for a sum of Rs.2,00,000/- with two sureties each for the like sum; that the sureties shall be the owner of movable or immovable property worth more than Rs.2,00,000/- and they shall furnish necessary documents to that effect. Now the petitioner has filed this Criminal Original Petition to modify the said condition.

3. Heard both the sides.

Taking into consideration the facts and circumstances of the case, the condition imposed by the learned V Metropolitan Magistrate, Egmore, Chennai in the order made in Crl.M.P.No.1859 of 2016 in Crime No.605 of 2016, dated 26.08.2016, in respect of executing a bond for a sum of Rs.2,00,000/- with two sureties each for the like sum, and that the sureties shall be the owner of movable or immovable property worth more than Rs.2,00,000/- and they shall furnish necessary documents, is modified to the effect that the petitioner shall execute a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties each for the like sum. Rest of the conditions imposed by the learned V Metropolitan Magistrate, Egmore, Chennai, shall remain unaltered.
5. This petition is ordered accordingly.
