While so, some aggrieved parties, who have not been appointed as Fair Price Shop dealers pursuant to the notification dated 10.10.2007 in respect of the aforesaid shops filed appeal before the Joint Collector, Warangal, who by order dated 26.12.2007 set aside the appointment of the petitioners as Fair Price Shop dealers on the sole ground that the notification dated 10.10.2007 issued by the first respondent was not in accordance with G.O.Ms.No. 53, dated 06.10.2003 as it does not provide reservation in respect of shortfall vacancies of STs and Physically Handicapped categories. Against the said order of the Joint Collector, the petitioners preferred revision before the District Collector and the said revision was dismissed by order dated 10.06.2008. During the pendency of the revision, the operation of the order of the Joint Collector dated 26.12.2007 was suspended, by virtue of which the petitioners have been continuing as Fair Price Shop dealers. Questioning the orders passed by the District Collector dated 10.06.2008, the petitioners filed Writ Petition No. 12615 of 2008, which was dismissed by this Court by order dated 18.06.2008. Writ Appeal No. 660 of 2008 preferred against the order dated 18.06.2008 passed in the said Writ Petition was ended in dismissal by order dated 07.04.2010. The SLP preferred before the Supreme Court thereon was also dismissed -
. Thereafter, the petitioners submitted a representation on 19.06.2010 seeking to continue them as Fair Price Shop dealers till the regular dealers are appointed and the said request was rejected by the second respondent by order dated 21.06.2010. Questioning the same, the present Writ Petition was filed.
This Court by interim order dated 25.06.2010 directed the respondents to continue the petitioners as Fair Price Shop dealers of the aforesaid shops until further orders while making it clear that the same does not confer any right on the petitioners to claim the appointment on permanent basis and the respondents were at liberty to issue fresh notification for appointment of permanent dealers.
The learned Government Pleader as well as learned Counsel for the petitioners submit that till today no notification was issued for appointment of Fair Price Shop dealers of the aforesaid shops on permanent basis.
In view of the same, while making the interim order of this Court dated 25.06.2010 as final order, the Writ Petition is closed.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs.
