HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29349 of 2014 ORDER:
Though the writ petition is filed alleging that the registering authority is insisting for production of No Objection Certificate on property to an extent of Ac. 2.00 cents in Survey No.1849-1 and to an extent of Ac. 0.96 cents in Survey No.1849-2, situated at Kadiri Village and Mandal, Anantapur District, when the matter is taken up for consideration, learned counsel for the petitioner requested to confine the relief of not insisting No Objection Certificate by the registering authority to the land to an extent of Ac. 2.00 cents in Survey No.1849-1.
2. Having regard to the submissions made, the Writ Petition is disposed of confining the relief claimed in the writ petition to Ac. 2.00 cents in Survey No.1849-1. Liberty is given to the petitioner to present the Deed of Conveyance before the Sub-Registrar, Kadiri, Anantapur District (3rd respondent). As and when such Deed of Conveyance is presented, the Sub-Registrar shall receive and process the same in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899 without insisting for no objection certificate from revenue authorities. If the Sub-Registrar has valid reasons for refusing to register the Deed of Conveyance, he shall pass orders under Section 71 of the Registration Act, 1908, and communicate the same to the petitioner within a period of two (2) weeks from the date of receipt of such document. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
