Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of respondent No. 2 in issuing the impugned letter vide No. SWC/CS3/0192/PEG-2008/PPP/12-13 Dt.10.01.2014 by not allowing the petitioner to submit the sealed tender document as illegal and arbitrary and consequently, set aside the same;
The petition coming on for hearing andupon perusing the petition and affidavit filed herein and order of the High Court dated 21-01- 2014 & 27-01-2014 and upon hearing the arguments of Sri P Kasi Nageswara Rao Advocate for the Petitioner and the G.P. for Marketing for Respondent No.1 and of Sri K . Srinivasa Reddy, learned Standing Counsel for the respondent No.2 and of Sri B.G. Ravindra Reddy, Standing Counsel for Respondent No.3, the Court made the following:
WPMP. No. 1307 of 2014 Petition under Section 151 of C.P.C. praying that in the circumstances stated in the affidavit filed in the W.P. the High Court may be pleased to direct respondent No. 2 to permit the petitioner to submit the sealed tender document, pending WP No. 1148 of 2014 on the file of the High Court.
The Court further made the following ORDER:
“This Court by order dated 21.01.2014 granted interim order to receive of the petitioner. It is stated that in pursuance of the interim order, bids of the petitioner were received. In view of the same, they are seeking further direction to consider the bids of the petitioner along with others.
In view of the above submission, the bids of the petitioner which is received by the respondents, may be opened and considered along with bids of other participants as per law.
Post after two (02) weeks.”
