Respondent Prayer: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent herein to consider for admission of the petitioner herein into law course admission -5 years B.A.L.L.B degree course 2017-18 in the Tamil Nadu Dr.Ambedkar Law University, Perungudi, Chennai.

While studying IX standard, due to family circumstances, he could not continue the education and therefore, as a private candidate, he wrote X Std. examination.
2. Thereafter, the petitioner joined Government Higher Secondary School, Kadalady, Ramanathapuram district and resumed XII standard as a regular student. He passed all subjects except mathematics in which the petitioner secured only 21 marks out of 200 marks.
3. Thereafter, the petitioner completed XII examination and applied for B.A.L.L.B., to the respondent/University. The respondent/University did not grant admission and therefore, the petitioner has come up before this Court, seeking a writ of mandamus to give admission to the writ petitioner into law course admission for five years B.A.L.L.B. degree course for the year 2017-18.
4. Heard, Mr.M.A.Subramanian, learned counsel for the petitioner and Mr.L.P.Shanmugasundaram, learned Standing Counsel appearing on behalf of the respondent/University.
5. First of all, it is not known whether the petitioner completed IX standard or not? Even the admitted case of the petitioner is that he has completed X standard not through school, but as a private student he studied and thereafter, he joined school at Government Higher Secondary School, Kadalady, Ramanathapuram district and made first attempt during March 1999 and only in 2008, he passed all the examinations in XII standard except mathematics, in which the petitioner obtained 21 marks out of 200 marks. Subsequently, after 2008, the petitioner has cleared the mathematics exam and applied for B.A.L.L.B.
6. As already stated, the petitioner is a private candidate in the X standard, without undergoing the course in the school. Secondly, in the prospectus, Clause V (2) mandates that the students should have passed 10 and +2 [X and XII standard] examinations in the first attempt, whereas, admittedly, the petitioner made first attempt to clear the higher secondary examination in the year 1999 and failed and thereafter, he cleared only after 10 years in the year June 2008 and as per Clause V (2) of the prospectus itself, the petitioner is not entitled to and not even qualified to apply for the course.
7. Accordingly, the writ petition stands dismissed. No costs.
Consequently, connected miscellaneous petition is closed.
