JUDGMENT / ORDER

This petition has been filed seeking a direction to the learned Sub Judge, Kancheepuram to expedite the trial in S.C.No.108 of 2012 within the stipulated time.
2. The learned counsel appearing for the petitioner would submit that the occurrence took place in the year 2012, and the final report also has been filed in the same year and the matter was taken on file in S.C.No.108 of 2012 on the file of the Sub Court, Kancheepuram and the matter was pending for more than four years, but till date trial has not been commenced in the case.
3. Mr.C.Emalias, the learned Additional Public Prosecutor, appearing for the state submitted that out of 20 accused, two accused have absconded and they were declared as proclaimed offender. In the above circumstances, the trial Court is not in a position to conduct trial.
4. Taking into consideration the facts and circumstances of the case, the learned Sub Judge, Kancheepuram is directed to take steps to spilt up the case against the absconding accused, and expedite the trial and dispose of the Criminal Case within a period of six months from the date of receipt of a copy of this order.
5. With the above direction, the criminal original petition is disposed of.
