JUDGMENT / ORDER

The petitioner is a permit holder of Transport permit to ply his stage carriage in bearing vehicle Reg. No.TN-57-E-7567 between Dindigul and Karur via Nallamanarkottaia, Eriodu, Kovilur, Puliampatti, Gujiliamparai, Gudalur, Landakottai, Vellianai and Thanthonimalai with IST between dindigul and Karur(Via) Nallamanarkottai, Eriodu, Kovilur Puliampatti, Gujiliamparai, Palayam, Gudalur, Pitchampatti Cross, Pitchampatti Vellianai and Thanthoniamalai touching Koombur so as to fly on the route Dindigul to Karur(via) Nallamanakottai, Eriodu, Koviloor, Puliampatti, Gujiliamparai, Palayam, Gudalur, Pitchampatti Cross, Pachapatti, Vellianai and Thanthonimalai touching (i) Koombur Cross-Koombur for a distance of 13.0 Kms (ii) Gudalur – Vellianai for a distance fo 7.0 Kms and additional singles 4 STs from Gudalur to Vellianai(via) Pitchampatti Cross and Pachapatti.
2. The petitioner made a request to the second respondent for grant of variations. The second respondent rejected the claim made by the petitioner, as against the order of the second respondent, the petitioner filed appeal before the first respondent. The first respondent without considering the matter on merits, remanded the matter to the second respondent, Regional Transport Authority.
3. The learned cousel appearing for the petitioner restricts the claim without going to the merits of the case, the matter may be remanded back to the second respondent as directed by the appellate authority.
4. Accordingly, the writ petition is disposed of with liberty to the petitioner to approach the second respondent as directed by the first respondent. No costs. Consequently the connected miscellaneous petition is also closed.
