This writ petition is filed under Article 227 of the Constitution of India, praying to quash the order dated 06.11.2015 passed on IA No.10 as per Annexure-E and consequential supplementary preliminary decree dated 16.11.2015 passed in as per Annexure-F passed in FDP No.34 of 2013 on the file of Senior Civil Judge & CJM, Chikmagalur.
This petition coming on for Preliminary Hearing ‘B’ Group, this day, the Court made the following:
ORDER 1. Defendant in FDP No.34/2013 on the file of I Addl.
Senior Civil Judge, Chikamagaluru, has come up in this writ petition impugning the order dated 06.11.2015 passed on IA No.10 and the consequential supplementary preliminary decree dated 16.11.2015.
2. When this matter is taken up for consideration this day, the stage of the proceedings in FDP No.34/2013 is looked into in the website of Chickmagaluru District Court. It is seen that FDP No.34/2013 has already been disposed of vide order dated 11.12.2018. Therefore, nothing survives for consideration in this writ petition as the same has become infructuous. Accordingly, this writ petition is dismissed as having become infructuous.
