THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1234 of 2014 ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This contempt application has been filed alleging wilful and deliberate violation of our direction dated 13.12.2013.
Admittedly, compliance has been recorded after contempt application has been filed. We fixed the time limit. This time limit was not adhered to. The respondent finally took his own time. We do not know the reasons behind. However, the Officer concerned should have approached this Court for extension of time to carry out the Court’s order. He cannot fix his own time ignoring Court’s stipulation.
Under these circumstances, we dispose of the Contempt Case recording compliance, however, awarding costs of this application in favour of the petitioner. Such costs is assessed at Rs.500/- (Rupees Five Hundred Only) and it shall be paid by the Government at the first instance within fortnight from the date of communication of a copy this order and thereafter, it is open for the Government to find out the person or persons, who is/are responsible for delayed compliance of order of this Court and the costs may be recovered from them or him from their own salary. We have passed this order because the petitioner has to incur further costs for filing the contempt application that eventually ensures compliance. Had the direction been complied with by the Officer concerned within the time, incurring of costs would have been avoided.
