. Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein, the High Court may be pleased to issue a writ, order or a direction, more particularly one in the nature of writ of mandamus, declaring the action of the respondents in seeking to demolish the structures raised in plots Nos.152 and 153 of Survey Nos.157 and 158, situated at Miyapur Village, Sherlingampally Mandal of Greater Hyderabad Municipal Corporation as being arbitrary, illegal and unreasonable, apart from being in gross violation of principles of natural justice and issue a consequential direction, directing the respondents not to demolish the structures.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and the order of the High Court dated 12-01-2011 made herein and upon hearing the arguments of Sri P. Laxma Reddy, Advocate for the Petitioner and Dr. Y. Padmavathy, learned Standing Counsel for the Respondents, the Court made the following ORDER:
Despite time having been granted, Dr. Y. Padmavathy, Learned Standing Counsel requests further time to file counter-affidavit.
Post on 09.06.2014.
In case no counter-affidavit is filed by then, respondents 1 and 2 shall be personally present in Court on 09.06.2014 at 10.30 A.M.
Dr. Y. Padmavathy, Learned Standing Counsel is present in Court and undertakes to inform the respondents 1 and 2 of their obligations under this order.
