Order:
This Contempt Case is filed alleging willful disobedience of Order, dated 24-08-2012, in WPMP.No.33332 of 2012 in WP.No.26159 of 2012, by the respondents.
By the above-mentioned order, this Court has suspended the proceeding bearing No.AB/A-3/B-3/572M, dated 04.07.2012, issued by respondent No.1 herein whereby he has ordered eviction of the petitioner from the residential quarter allotted to him.
I have perused the respective pleadings of the parties and heard the learned Counsel representing them.
The learned Assistant Government Pleader for Irrigation appearing for the respondents submitted that, by the time the interim order was passed by this Court, the petitioner has handed over the possession of the quarter; that on the strength of the interim order, he has re-occupied the quarter and that he is presently in possession of the same. He has further stated that the petitioner is liable to pay Rs.11,404/- towards arrears of rent.
Mr.P.Rajasekhar, learned Counsel for the petitioner, while denying the submission of the learned Assistant Government Pleader that his client has vacated the premises at any point of time, however, submitted that his client is willing to pay the arrears of rent as mentioned above.
Inasmuch as the petitioner is, admittedly, in possession of the quarter as on today, and as the eviction order is under suspension, the respondents shall not interfere with his possession till further orders in the pending Writ Petition are passed. The petitioner shall pay the sum of Rs.11,404/- towards arrears of rent within two weeks from today and he shall pay the future rents on or before the due date without committing any default, pending the Writ Petition.
Subject to the above directions, the Contempt Case is disposed of.
