JUDGMENT / ORDER

This Criminal Original Petition has been filed seeking a direction to the first respondent not to interfere with the petitioner's right and title in respect of the property situated at No.123, Motchapuram 6th Street, Korukupet, Chennai – 600 021.
2. According to the petitioner, he purchased the property at No.123, Motchapuram 6th Street, Korukupet, Chennai- 600 021, belonging to the second respondent herein, through public auction. After receiving the vacant possession of the same, he started construction work. However, the second respondent objected the commencement of the construction work and caused disturbance to the same. Hence, the petitioner lodged a complaint on 06.06.2017 to the first respondent, who, on receipt of the same, called both the parties for enquiry, during which, the second respondent has given an undertaking not to interfere with the construction work of the petitioner. Pursuant to the said undertaking, the petitioner started construction work. While so, on 10.06.2017, the first respondent at the instigation of the second respondent, again called the petitioner and directed him to stop the work immediately. Therefore, the petitioner has no other option except to approach this Court with the present petition for the above stated relief.
3. Learned Additional Public Prosecutor taking notice for the first respondent, on instructions, submitted that there was no hindrance or trouble caused by the respondent police, as alleged by the petitioner.
4. Recording the said submission made by the learned Additional Public Prosecutor, this Court directs the first respondent to consider the representation of the petitioner dated 06.06.2017 and conduct enquiry by calling upon the petitioner as well as the second respondent and advice them as provided under law. Such exercise shall be completed by the first respondent within a period of three weeks from the date of receipt of a copy of this order. This Criminal Original Petition is disposed of accordingly.
