The petitioner challenging Ext.P4 order black listing the petitioner's product, has approached the Government by Ext.P6 appeal. This was disposed as per Ext.P8. It is challenging Ext.P8, this writ petition is filed. The petitioner points out that, in fact, the original order passed in Ext.P4 was also without giving an opportunity of being heard, so also in Ext.P8. The petitioner has serious objection in black listing his product.
2. I have gone through Exts.P4 and P8 orders. It is true that the petitioner was given show cause notice and the petitioner was given reply to the show cause notice. However, it is not clear from Ext.P4 order that the petitioner was heard before Ext.P4 order is passed. I am of the view, the entire matter require reconsideration at the hands of the 4th respondent. Therefore, Exts.P4 and P8 WP(C).No.33845/2014-E.
2 orders are set aside. The 4th respondent, after hearing the petitioner in person, shall pass appropriate orders in the matter within a period of two months.
Writ petition is disposed of as above.
