ORDER:
This writ petition is filed for a Mandamus to set aside proceedings No.H1/1604/2006 dated 22.02.2007 of respondent No.2, to the extent of Ac.13-28.9 gts. in Sy.Nos.202/2/A and 203/A, comprised in Srila Gardens Layout, Madinaguda Village, Serilingampally Mandal, Ranga Reddy District.
At the hearing, it is agreed by the learned Assistant Government Pleader for Revenue (Assignment) that the proceedings impugned in this writ petition, which covers the total extent of Ac.40-33 gts. or 1,65,213.01 sq.mtrs. in various survey numbers, was the subject matter of W.P.No.21550 of 2010 to the extent of Ac.6.00 comprised in Sy.Nos.203, 204, 205/1 and 206/A of Madinaguda Village and that the said writ petition was allowed by a learned single Judge, by his order dated 18.06.2012. The learned Assistant Government Pleader also agrees that the said judgment was confirmed in W.A.No.1495 of 2012 by a Division Bench, by its order dated 05.06.2013. In view of this admitted fact, this writ petition to the extent of Ac.13-28.9 gts., which is also claimed to be part of the extent of Ac.40-33 gts. covered by the impugned proceedings, deserves to be allowed.
Accordingly, this writ petition is allowed in terms of the above-mentioned two judgments and the impugned proceeding to the extent of the above-mentioned land claimed by the petitioners stands set aside.
As a sequel, W.P.M.P.No.45553 of 2013 shall stand disposed of as infructuous.
