O R D E R:
Heard learned counsel for the petitioner and learned Government Pleader for respondents 1 and 2.
2. The petitioner submitted an application through proper channel on 30.08.2008 under Rule 9 of A.P. Minor Minerals and Concession Rules for grant of lease of Limestone in Survey Nos.312 to 317 and 417 of Palukuru Village, Banaganapalli Mandal, Kurnool District. After submission of the application on 30.08.2008 and when no communication was received, the petitioner filed W.P. No.12289 of 2009. The said writ petition was disposed of on 28.07.2009 on the statement made by the Government that the application of the petitioner was rejected on 25.02.2009 and the same was informed by letter dated 27.07.2009.
3. The learned counsel for the petitioner fairly submits that there is a provision for appeal against the impugned letter No.4300/M4/2008 dated 27.07.2009 rejecting the quarry lease application of the petitioner filed on 02.09.2008 (dated 30.08.2008).
4. In the circumstances, this writ petition is disposed of giving liberty to the petitioner to avail the remedy of appeal against the rejection application of the petitioner vide proceedings No.354/Q2/2009 dated 25.02.2009 which was communicated by the Assistant Director of Mines and Geology under the impugned letter dated 27.07.2009 to the learned Government Pleader, High Court of A.P. Since the impugned letter is only a communication from the Assistant Director of Mines and Geology to the learned Government Pleader, the 2nd respondent is directed to communicate a copy of the order dated 25.02.2009 to the petitioner within a period of fifteen (15) days from the date of receipt of a copy of this order in order to enable the petitioner to file an appeal within thirty (30) days thereafter. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
