For Petitioner : Mr.P.Kalimuthu For Respondent : Mr.V.S.Kesavan O R D E R This Transfer Civil Miscellaneous Petition is filed to withdraw and transfer the case in I.D.O.P.No.48 of 2016 from the file of the Principal District Court, Tiruppur, to the file of the Principal District Court, Erode.
2. The petitioner is the husband and the respondent is the wife. Since there has been matrimonial dispute pending between them, the husband has filed I.D.O.P.No.48 of 2016, before the Principal District Judge, Tiruppur, seeking for divorce. It is stated that the petitioner's permanent residence is Tiruppur District and the respondent/wife is residing in Vijayamangalam, Erode District. Since it is stated that travelling distance between Erode and Tiruppur is 45 minutes, the petitioner/husband seeks for transfer of the said I.D.O.P.No.48 of 2016 to Erode.
3. Taking into consideration the above facts and also considering the distance between the Erode and Tiruppur, I.D.O.P.No.48 of 2016 pending on the file of the Principal District Court, Tiruppur, shall stand transferred to the Principal District Court, Erode. The Principal District Court, Tiruppur, is directed to transmit all the records relating to the petition in I.D.O.P.No.48 of 2016 to the Principal District Court, Erode, forthwith.
4. This Transfer Civil Miscellaneous Petition is ordered, accordingly. Consequently, connected miscellaneous petition is closed. No costs.
