This Writ Petition is filed with the grievance that pending the appeal, filed by the petitioner against the order passed by respondent No.3 vide Ref.No.D/986/2014, dated 17-09-2014, suspending his fair price shop authorization pending enquiry, respondent No.2 has not passed interim order.
At the hearing, Mr.G.Tuhin Kumar, learned Counsel for the petitioner, submitted that after filing of this Writ Petition, respondent No.2 has passed an order rejecting the petitioner’s application filed for grant of interim order, pending the appeal.
In view of the said development, the cause in the Writ Petition, as conceived, does not survive. Accordingly, the Writ Petition is dismissed, however, with liberty to the Writ Petitioner to avail appropriate remedy, if he feels aggrieved by the rejection order stated to have been passed by respondent No.2.
As a sequel, WPMP.No.36696 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
