Respondents Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF HABEAS CORPUS, to direct the 2nd respondent herein to produce the minor daughter namely Renuka Parameswari, aged about 17 years herein from wrongful confinement of the third respondent and produce her before this Court and set her at liberty.
For Petitioner : Mr. A.Ilaya Perumal For Respondent : Mr.V.M.R.Rajentren, Additional Public Prosecutor O R D E R [Order of the Court was made by A.SELVAM, J.] This Habeas Corpus Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents 1 and 2 to trace out and produce the detenue by name Renuka Parameswari, aged 17 years, daughter of the petitioner.
2. The petitioner is not present, whereas his counsel is present. The second respondent viz., The Inspector of Police, Vadavanakkampadi Police Station, has produced the detenue and she has stated that she is the daughter of the petitioner.
3. It is seen from the records that the detenue has got birth on 12.07.1999 and therefore, now she attained majority.
4. It has already been pointed out that for making identification, father of the detenue is not present. Under such circumstances, the present petition deserves to be dismissed.
5. In fine, this petition is dismissed.
