THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.12403 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioners and the learned standing counsel appearing for the respondents corporation.
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not disposing the petitioners representation dated 26-
11-2008 and not taking any further steps as per the letter No.E2/684(1)/2013-PTR, dated 23-05-2013 of the 3rd respondent as arbitrary, illegal and violative of Article 21 of the Constitution of India and consequently direct the respondent corporation authorities to dispose of the petitioners representation dated 26-11-2008 and also direct the respondents to initiate further steps consequent to the letter No.E2/684(1)/2013-PTR, dated 23-5-2013 of the 3rd respondent in respect of compassionate appointment scheme (Job Under Bread Winner Scheme) of the 2nd petitioner.
The first petitioner is the wife and second petitioner is the son of the deceased employee Aswathama. It is stated that the deceased employee died in harness while he was working as driver in Puttur Depot, Chittoor District. The petitioners made a representation dated 26-11- 2008 to the second respondent to provide employment to the second petitioner on compassionate grounds. The second petitioner is a commerce graduate and he seeks appointment to the post of conductor/driver or any other suitable post.
The grievance of the petitioners is that no steps have been taken by the respondents on the representation submitted by the petitioners on 26-11-2008. It is stated that the 3rd respondent wrote a letter dated 6-5- 2013 directing the Security Assistant Sub Inspector to verify the antecedents of the second petitioner, but so far, no action has been taken.
Under these circumstances, the respondents are directed to consider the representation made by the petitioners, seeking compassionate appointment to the second petitioner as per the Job Under Bread Winner Scheme in respondent corporation, subject to the second petitioner fulfilling the requirements for the said appointment as per rules, within a period of three months from the date of receipt of copy of this order.
With the aforesaid direction, the writ petition is disposed of. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
