JUDGMENT / ORDER

Order:
This Writ Petition is filed by one of the card holders of fair price shop No.23 of Mudivarthy Village, Nellore District, feeling aggrieved by non- consideration of the representation made by herself and some of the villagers of Mudivarthy Village for restoring the authorization of the permanent dealer viz., Smt.J.Sujana.
A perusal of the averments contained in the affidavit, filed in support of the Writ Petition, shows that the authorization of Smt.J.Sujana relating to the above-mentioned shop was suspended and that, in her place, another fair price shop dealer was kept in- charge. The petitioner and some of the villagers of Mudivarthy Village have made a representation to respondent No.2, on 09.07.2014, wherein they have represented that while the permanent dealer- Smt.J.Sujana was distributing the essential commodities to the satisfaction of all the card holders, her authorization was suspended and that the in-charge dealer has been causing severe inconvenience to the card holders as he is not only irregular in distribution of the essential commodities but also diverting the same to the black market.
From the facts pleaded by the petitioner, it appears that the enquiry against the permanent fair price shop dealer is pending before respondent No.4. It is, therefore, appropriate that respondent No.4 completes the enquiry and passes a final order expeditiously.
Accordingly, respondent No.4 is directed to hold a detailed enquiry wherein he shall give an opportunity of personal hearing to Smt.J.Sujana to put forth her case. After completing the enquiry, he shall pass a reasoned order and communicate the same to Smt.J.Sujana. Respondent No.4 shall complete this exercise within a period of six weeks from the date of receipt of a copy of this order.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.46855 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
