Prayer: Civil Revision Petition filed under Article 227 of Constitution of India to direct the office of the learned Chief Small Causes Judge, Chennai to affix the seal in the Xerox copy of the Decree dated 24.08.1993 made in RCA No.1222 of 1991 on the file of IV Small Causes Court, Chennai confirming the decree dated 07.11.1990 made in RCOP No.1482 of 1988 on the file of XIV Small Causes Court, Chennai in CA.SR.No.27018 of 2016.
For Petitioner : Mr.M.Raja Shankar (in all CRP's) C O M M O N O R D E R These Civil Revision petitions have been filed seeking to direct the office of the learned Chief Small Causes Judge, Chennai to affix the seal in the Xerox copies of the decrees dated 24.08.1993 and 03.12.1998 made in RCA.Nos. 1199 of 1991, 252 of 1993 and 1222 of 1991 and furnish the same to the petitioner.
2. In order to verify the submission made by the learned counsel for the petitioner,this Court by an order dated 04.07.2017, has directed the Registrar, Small Causes Court to file a report in respect of the decrees passed in these matters.
3. On a perusal of the records from the Court below, this Court Could not find the decree copy passed in these matters.
4. The learned counsel for the petitioner would submit that he has xerox copies of the decree made in RCA.Nos.1199 of 1991, 252 of 1993 and 1222 of 1991 and seeks for a direction to the Chief Small Causes Judge, Chennai, to affix the seal and furnish the same to the petitioner, in order to proceed further.
5. In these peculiar facts and circumstances and on perusal of the records from the Court below, this Court deems it fit to issue a direction to the Small Causes Court to affix the seal in the decree copies of the R.C.A.Nos.1199 of 1991, 252 of 1993 and 1222 of 1991 and issue certified copies to the petitioner.
6. Accordingly, the petitioner is directed to produce the xerox copy of the R.C.A.Nos.1199 of 1991, 252 of 1993 and 1222 of 1991,before the Chief Small Causes Judge, Chennai who inturn is directed to affix the seal and issue certified copies of the decrees to the petitioner, to enable him to proceed further in this matter.
7. With the above directions, these Civil Revision Petitions are allowed. No costs.
