RESPONDENTS THIS CRL.PETITION IS FILED U/S.482 CR.P.C PRAYING TO QUASH THE CHARGE SHEET FILED AGAINST THE PETITIONER IN SPECIAL CASE NO.42/2015 ON THE FILE OF THE VI ADDITIONAL DISTRICT AND SESSIONS JUDGE MYSORE, ARISING OUT OF CRIME NO.31/2014 OF CITY CRIME BRANCH POLICE MYSORE (CCB) BY ALLOWING THIS PETITION.
THIS PETITION COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Heard the learned Advocate for the petitioner and the learned HCGP for the State.
2. Sri.Raju, learned Advocate for the petitioner submits that Criminal Proceedings against Accused Nos.1, 3 and 4 were quashed by this Court in Writ Petition No.24437/2015 and connected cases by order dated 19.09.2018. Complainant challenged the said order before the Hon’ble Supreme Court of India and the same has been dismissed. Subsequently, in respect of accused No.6, this Court has quashed the proceedings in Criminal Petition No.1722/2017 by order dated 6.06.2019, wherein it has been recorded that the SLP filed against the earlier order has been dismissed.
3. Learned HCGP does not dispute the facts stated by the learned Advocate for the petitioner.
4. The offences alleged against all the accused are common in nature.
In the circumstances, this petition is allowed. Proceedings in Special Case No.42/2015 on the file of VI Addl. District and Sessions Judge, Mysore, is quashed.
In view of disposal of the petition, I.A.No.1/2018 does not survive for consideration and it is disposed of.
No costs.
