ORDER:
This Writ Petition is filed for a Mandamus to set aside proceedings in Rc.No.2559/2014/B, dated 23.08.2014, of respondent No.2, whereby he has suspended the petitioner’s fair price shop authorization.
Considering the fact that the impugned order was passed as far back as 23.08.2014 pending enquiry, I am not inclined to interfere with the said order at this stage. Instead, respondent No.2 is directed to complete the enquiry, wherein the petitioner shall be given an opportunity of being heard personally besides being supplied with report, dated 15.08.2014, of respondent No.3 referred to in the impugned show cause notice-cum- suspension order. Respondent No.2 shall also allow the petitioner to controvert the statements of the 66 card holders whose names have been mentioned in the impugned show cause notice-cum-suspension order. At the end of enquiry, respondent No.2 shall pass a detailed speaking order and communicate the same to the petitioner. He shall complete this exercise within one month from the date of receipt of a copy of this order.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.48475 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
