THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29990 of 2014 ORDER :
The petitioner claims to be the owner and possessor of the land admeasuring Ac.0-21 guntas in Survey No.96/D, Thrimulghery Village, Secunderabad. This writ petition is instituted alleging that the respondent-Contonment Board, is encroaching upon the land of the petitioner, conducting survey and taking steps to demolish the compound wall of the petitioner.
2. On instructions, learned Standing Counsel representing the Contonment Board, submits that the Contonment Board Officers have never visited the site which the petitioner is claiming and no steps were taken for undertaking survey or for demolition of the compound wall as alleged by the petitioner.
3. Having regard to the submissions made by the learned Standing Counsel, this writ petition is premature and accordingly dismissed. There shall be no order as to costs.
4. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
