ORDER:
This Writ Petition is filed to declare the action of respondent No.3 in keeping an adjacent dealer as in-charge and addressing letter No.C/356/2014, dated 23-9-2014 to respondent No.2 to take action against the petitioner, as illegal and arbitrary.
This Court has adjourned the case on 8-10-2014 to enable the learned Government Pleader to advise the respondents to ensure that the Revenue Divisional officers and Tahsildars do not resort to such actions as impugned in this Writ Petition.
At the hearing, the learned Assistant Government Pleader for Civil Supplies has placed before the Court letter dated 9-10-2014 addressed by respondent No.3 to respondent No.2 wherein he has retraced the steps taken and requested respondent No.2 to drop further action.
A perusal of this letter shows that respondent No.3 is asserting that he has power to make in-charge arrangement without suspending the petitioner’s authorisation. While making it clear that the impugned proceedings issued by respondent No.3 are wholly without jurisdiction, since he has issued a fresh proceeding on 9-10-2014, referred to above, dropping further action against the petitioner, the Writ Petition is closed with a caution to respondent No.3 not to repeat such conduct in future.
As a sequel to the disposal of the Writ Petition, WPMP No.37235 of 2014 is disposed of as infructuous.
