Heard Ms. Jyoti Mani Pandey, learned counsel for the petitioner, Sri Kunal Shah, learned counsel appearing for respondent no.1 and 2 and perused the record.
By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has questioned the tender awarded to Smt. Tilotma Devi dated 28.1.2019 at certain price.
We find that the petitioner was also one of the tenderers pursuant to the notice inviting tender in question and the petitioner has already been relegated to the remedy of appeal/representation before the competent authority as per Clause 12 of the notice inviting tender and order to that effect passed on 29.11.2019 in Writ-C No.39177 of 2019 has been filed by the petitioner himself as Annexure-9 to the writ petition. We are of the view that since we have directed the petitioner to approach the authority concerned, it is proper for the petitioner to first pursue that remedy.
Sri Kunal Shah, learned counsel appearing for the contesting respondents submits that the petitioner's objection/representation shall be disposed of positively by 25th December, 2019.
In such view of the matter, we are not inclined to interfere in the matter at this stage. The writ petition is, accordingly dismissed.
