Heard Ms. Jyoti Mani Pandey, learned counsel for the petitioner, Sri Kunal Shah, counsel for respondent nos. 1 and 2 and perused the record.
By means of this writ petition under article 226 of the constitution, the petitioner has sought a direction to the respondent to qualify the petitioner against the notice inviting tenders at the stage of technical bid.
The present writ petition has come to be filed on the ground that the petitioner's complaint has remained pending with the respondents.
However, Sri Kunal Shah, counsel appearing for the respondent has placed before us the order dated 9.12.2019 whereby the complaint of the petitioner though has been accepted on several points but has been finally rejected on the point of non furnishing of net-worth certificate and states that it is open for the petitioner to challenge the order dated 19.12.2019 assailing the finding resolved therein.
Learned counsel for the petitioner is, therefore, permitted to file a fresh writ petition, if so advised, challenging the order dated 9.12.2019.
With the aforesaid liberty the writ petition stands dismissed.
