ORDER:
This writ petition is filed with the grievance that respondent No.2 has not been passing a final order, though the petitioner has submitted his explanation on 20.08.2014 in pursuance of the show-cause notice issued by the former.
At the hearing, the learned Assistant Government Pleader for Civil Supplies, on instructions, stated that enquiry has been completed and passing of a final order is deferred, as the petitioner has not appeared before respondent No.2.
In my opinion, if the petitioner has received the notice and chosen not to appear before respondent No.2, the latter is not under obligation to await the petitioner’s appearance without passing a final order. Respondent No.2 is, therefore, directed to complete the enquiry, if the same has not been done so far, pass a final order and communicate the same to the petitioner, within one month from the date of receipt of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.33843 of 2014 shall stand disposed of as infructuous.
